Please read these Terms and Conditions ("Terms") carefully before using the Tinkki website and service (the "Service") operated by Plutus X ("us," "we," or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
1. The Service
Tinkki provides an AI-powered service that transforms a photograph of a child into a stylized, grown-up version in a "dream job" role. To use the Service, you must provide a photograph and other required information.
2. User Requirements
- Age Requirement: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract.
- Parental Consent: You must be the parent or legal guardian of any minor depicted in the photographs you upload. You represent and warrant that you have the legal authority to consent to the use of the child's image as described in these Terms.
3. User-Provided Content
To provide the Service, we require you to upload photographs ("User Content").
- License for Service Provision: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and create derivative works from your User Content for the sole purpose of providing the Service and fulfilling your order. This license terminates automatically when your User Content is deleted from our systems as per our Privacy Policy.
- Optional License for Marketing: You may be given the option to grant us a separate, perpetual, worldwide, non-exclusive, royalty-free license to use your original User Content and/or the final generated images for our marketing and promotional purposes (e.g., on our website or social media). This license is entirely optional and is not required to use the Service.
- Prohibited Content: You agree not to upload any User Content that is illegal, defamatory, obscene, or infringing on the rights of any third party.
4. Content Filtering and Safety
We implement advanced content filtering systems to ensure a safe, family-friendly experience for all users:
- Automatic Filtering: Our system automatically blocks inappropriate dream job requests including explicit content, violence, illegal activities, celebrity names, and other content unsuitable for children.
- Alternative Suggestions: When content is blocked, our system provides helpful suggestions for appropriate career alternatives.
- Monitoring: All blocked requests are logged for monitoring and system improvement purposes.
- Compliance: This filtering system helps ensure compliance with child safety regulations and maintains the educational, inspirational nature of our service.
5. Ownership of Generated Images
You, the user, retain full ownership rights to the final AI-generated images created from your order. We claim no ownership over the final artwork.
6. Payments and Refunds
All payments for the Service are processed through our third-party payment processor, Stripe, Inc. By making a purchase, you agree to their terms of service. Our policy on refunds is detailed in our Refund Policy.
7. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AI image generation is a new and evolving technology, and we do not warrant that the results will be free of artifacts, inaccuracies, or imperfections, or that they will meet your specific expectations.
8. Governing Law
This Agreement, including the End User License provisions, is governed by United States law and, where applicable, European Union law. In the event of a legal dispute, jurisdiction shall rest with competent courts in both the United States and the European Union.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes.
